General Terms & Conditions & Cancellation Policy:

1. scope:

For all business relations between EXIT Escape Room GmbH, Kapuzinerstraße 11, 53111 Bonn (hereinafter: TIMEBREAK) and the customer, the following General Terms and Conditions apply exclusively. Other terms and conditions of the customer will not become part of the contract, even without express objection by TIMEBREAK, even in the case of our performance.

2. offers, order process, conclusion of contract, correction of input errors, storage of the contract text:

2.1 Tickets and vouchers for TIMEBREAK can be purchased via our website www.timebreak-bonn.de or during our opening hours in our business premises. Only persons of legal age are entitled to purchase.

2.2 The ticket and voucher offers in our online store represent a non-binding invitation to order tickets or vouchers for TIMEBREAK. By clicking the "Place binding order" button, the customer submits a legally binding offer to purchase the tickets or vouchers in the shopping cart. Before submitting the order, the customer can view and change the data at any time. Required information is marked with an asterisk (*). The message automatically generated by us after sending the order documents that we have received your booking, but does not yet constitute acceptance of the customer's offer. The contract only comes into effect with our declaration of acceptance, which is sent in a separate, further e-mail (booking confirmation). The booking confirmation entitles the customer to access the booked game. In the event that the customer has ordered a voucher, the voucher code that entitles the customer or the person to whom the customer passes on the voucher to use the voucher amount as a means of payment when purchasing tickets will be communicated to the customer in the booking confirmation email.

2.3 The Customer shall ensure that the e-mail address provided by it for order processing is accurate and sufficiently configured (e.g. with regard to SPAM filters) and that it has sufficient free storage space.

2.4 The customer can correct input errors at any time during the ordering process by clicking on the form fields of and correcting them.

2.5 The information from the ordering process will be sent to the customer once again with the e-mail confirmation of the order.

3. prices, terms of payment:

3.1 The prices stated in our online store include the statutory value added tax.

3.2 Payment for tickets and vouchers ordered in our online store shall be made by credit card (VISA and Mastercard), instant bank transfer, PayPal, Giropay or on site with us in cash, with EC card or credit card. We reserve the right to accept other payment methods in individual cases and to reject payment methods in individual cases.

4. right of withdrawal

4.1 Pursuant to Section 312g (2) Sentence 1 No. 9 of the German Civil Code (BGB), there is no right of revocation for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision. The purchase of tickets for games at TIMEBREAK can therefore not be revoked by the customer.

4.2 The following also applies:
If the customer is a natural person who enters into a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity (consumer), the customer shall have a right of revocation pursuant to § 312g of the German Civil Code (BGB).

in conjunction with. § 355 BGB. With regard to the prerequisites and legal consequences of the right of revocation, reference is made to the revocation instruction in the appendix.

5. booking conditions

5.1 TIMEBREAK is a team game for people aged 12 to 99. From the age of 14, young people count as full payers and can play the rooms without an accompanying adult. From ages 9 to 14, children may participate in the experience with adults, as long as the maximum number of participants is not exceeded. If a game is not suitable for children, this is stated in the description of the room.

5.2 TIMEBREAK is entitled to deny visitors access to the gaming rooms if there is a fear that the person(s) concerned will disturb the general business operations due to alcohol or drug consumption or for other reasons, or that they will disturb other visitors. A refund of the ticket price or voucher value will not be made in these cases.

5.3 Please note that our games are live events. Since the game rooms are specially prepared for each booking and blocked for the booked period, it is your responsibility to arrive on time for the booked period. In case of delays, TIMEBREAK reserves the right to refuse admission to the game in question. The ticket will expire and there will be no right to a refund.

5.4 It is not permitted to bring your own food and drinks.

5.5 It is not allowed to bring bulky or dangerous objects, fireworks or other pyrotechnic objects, weapons and dangerous tools, spray cans, noise instruments, laser pens, bottles, cans, intoxicants and animals - with the exception of those required for assistance in case of physical or mental disability.

5.6 It is not permitted to bring cell phones, picture, film and sound recording devices into the game rooms.

5.7 It is not permitted to make sound, image or film recordings during the Games or of the premises or to transmit or distribute such recordings in whole or in part via the Internet or other media (including mobile telephony).

5.8 Serious or repeated violations of laws or these terms and conditions may be punished by expulsion from the TIMEBREAK premises without refund of the ticket price or voucher value and by ban from the premises.

6. cancellations

6.1 Cancellation conditions:

You can cancel or change your appointment more than 48 hours before the start of the game free of charge. To do so, please send a simple email to hallo@timebreak-bonn.de.

Cancellations made between 48 and 24 hours before the start of the game will be charged a cancellation fee of 50€.

If you cancel less than 24 hours before the start of the game, a fee of 90€ will be charged.

If you have booked more than 2 rooms, the cancellation must be made at least 14 days before the start of the game. Failure to meet this deadline will result in a fee of 90€ per booked room.

All dates booked as part of a promotion & event campaign (e.g. BlackFriday / BlackWeekend) are exempt from these cancellation conditions. In this case, the cancellation conditions on the promotion page apply.

7. changes in performance

Deviations in content and changes to the games after booking will only be made if necessary, provided they are not substantial and do not significantly affect the overall content or effect of the booked game.

8. sound, image and film recordings

8.1 TIMEBREAK is entitled to make sound, image and film recordings of the customer as well as his fellow players during the games, which are necessary for the execution of the game.

9. liability

In the event of impossibility and default as well as in the event of breach of material contractual obligations, we shall also be liable in the event of slight negligence, but then limited to the typical foreseeable damage. Essential contractual obligations (cardinal obligations) are those contractual obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner regularly relies and may also rely. Typical, foreseeable damages are those which are subject to the protective purpose of the respective violated contractual norm. Otherwise, we shall not be liable for slight negligence. The above limitations of liability shall also apply to our executive bodies and vicarious agents.

10. set-off, contract language

10.1 The customer shall only be entitled to set-off if its claim is undisputed or has been finally determined by a court of law, unless the claim is based on the same contractual relationship. The customer shall only be entitled to a right of retention if its counterclaim is based on the same contractual relationship.

10.2 The contract shall be concluded in the German language. All disputes arising from the legal relationship existing between the customer and us shall be governed by the laws of the Federal Republic of Germany. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence. The validity of the UN Convention on Contracts for the International Sale of Goods is excluded.
